Email Disclaimer

This disclaimer applies to emails sent by or on behalf of Debt Fix Pty Ltd (ABN 63 116 007 848), Australian Credit Licence 393436, including any attachments and information accessible through links in those emails.

Intended recipient and confidentiality

An email from Debt Fix and any attachments may contain confidential, personal, commercially sensitive or legally privileged information. It is intended only for the person or organisation to whom it is addressed.

If you are not the intended recipient, you must not read, use, copy, forward, disclose, distribute or otherwise act on the email or its contents. Please notify the sender immediately, permanently delete the email and any attachments, and destroy any printed copies.

Receiving an email in error does not waive confidentiality or legal professional privilege. However, no statement in this disclaimer is intended to assert privilege where it does not otherwise exist at law.

Privacy

Emails from Debt Fix may contain personal information protected by the Privacy Act 1988 (Cth). Personal information must only be handled, used and disclosed for the purpose for which the email was sent, or as otherwise authorised or required by law.

If you receive personal information in error, suspect that information has been sent to an unauthorised person, or become aware of any loss, misuse or unauthorised access or disclosure, please contact Debt Fix immediately on 1300 332 834.

Debt Fix handles personal information in accordance with its Privacy Policy, available at www.debtfix.com.au/legal-policy/privacy-policy.

Information and Reliance

Information contained in an email is provided in the context of the particular communication and may be incomplete, preliminary or subject to change. It should not be relied upon independently of any qualifications, assumptions, supporting documents or formal advice referred to in the email.

Unless expressly stated otherwise, an email does not constitute legal, taxation, accounting or financial product advice. You should obtain independent professional advice where appropriate.

Any general information about debt solutions, credit, hardship, bankruptcy or debt agreements does not take into account a person’s complete circumstances and is not a recommendation that a particular option is suitable. Debt Fix will only provide credit assistance or a personalised recommendation after completing the enquiries, assessment and disclosures required by applicable law.

Nothing in an email varies, replaces or overrides a signed agreement, formal proposal, statutory document, disclosure document or written determination unless Debt Fix expressly confirms the variation through an appropriately authorised representative.

Instructions and Authority

Debt Fix may rely on instructions received from an email address previously provided or used by a client or authorised representative. Debt Fix may require identity verification, confirmation through another communication channel, or further written authority before acting on an instruction.

An email does not create a binding agreement, waive a legal right, admit liability, settle a dispute or commit Debt Fix to a particular course of action unless this is expressly stated and confirmed by a person authorised to do so.

The opinions expressed in an email are those of the sender unless the email expressly states that they are the opinions of Debt Fix.

Cybersecurity and Payment Fraud

Email communications are not guaranteed to be secure, uninterrupted, timely or free from interception, corruption, errors or malicious software. While Debt Fix takes reasonable precautions, recipients are responsible for using appropriate security controls and checking attachments and links before opening them.

Fraudsters may impersonate businesses or alter payment instructions. Do not rely solely on an email advising of new or changed bank account details. Verify payment instructions by calling Debt Fix on 1300 332 834 using a trusted contact number before transferring funds.

Debt Fix will never ask you by email to disclose your password, complete login credentials, one-time security code or PIN. If an email appearing to come from Debt Fix seems unusual or suspicious, do not reply, follow its links, open its attachments or make a payment. Contact Debt Fix separately using the details published on its official website.

Transmission Errors and Viruses

Debt Fix does not warrant that an email has been transmitted without error, delay, interception or alteration. To the extent permitted by law, Debt Fix does not accept liability arising from a transmission error, malicious software or unauthorised interference that was beyond its reasonable control.

Recipients should maintain their own virus protection, backups and cybersecurity safeguards.

Limitation of Liability

To the maximum extent permitted by law, Debt Fix excludes liability for loss arising solely from:

  • reliance on incomplete, preliminary or unauthorised email content;
  • use of an email by someone other than its intended recipient;
  • a recipient’s failure to independently verify suspicious or changed payment instructions;
  • delay, corruption, interception or unauthorised alteration of an email beyond Debt Fix’s reasonable control; or
  • malicious software not caused by Debt Fix’s failure to take reasonable precautions.

Nothing in this disclaimer excludes, restricts or modifies any right, guarantee, condition, remedy or liability that cannot lawfully be excluded, including under the Competition and Consumer Act 2010 (Cth), the Australian Securities and Investments Commission Act 2001 (Cth), the National Consumer Credit Protection Act 2009 (Cth) or the Privacy Act 1988 (Cth).
