Debt Fix Pty Ltd – General Terms and Conditions

1. Introduction.

Debt Fix Pty Ltd (“Debt Fix”, “we”, “us”, or “our”) provides debt management, credit assistance, and insolvency administration services to individuals seeking assistance with unmanageable debt. By engaging our services, you (“the client”, “you”, or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Terms and Conditions apply to all services provided by Debt Fix, including but not limited to:
- Debt management, negotiation, and consolidation services;
- Debt Agreement administration under Part IX of the Bankruptcy Act 1966 (Cth);
- Credit assistance and broking services;
- General financial hardship support and referral services.

2. Nature of Our Services

Debt Fix provides information, options, and administrative support to help clients understand and manage their debt. Debt Fix does not provide legal, accounting, taxation, or financial advice. Any information provided should be considered general in nature and should not be relied upon as advice specific to your personal circumstances.

You should obtain independent legal, accounting, and financial advice before making any decisions regarding debt management or credit products.

3. Authorisations and Registrations

Debt Fix Pty Ltd holds the following authorisations: - Australian Credit Licence (ACL No. 393436) – permitting us to provide credit assistance and act as a credit broker under the National Consumer Credit Protection Act 2009 (Cth); - Registered Debt Agreement Administrator (RDAA No. 1027) – under the Bankruptcy Act 1966 (Cth), allowing us to administer Part IX Debt Agreements.

4. Fees and Costs

Depending on the service or solution you choose, fees and costs may apply and will vary depending on your circumstances and the level of service required. Before you agree to any service, you will be provided with a written disclosure detailing applicable fees, charges, and any potential commissions.

You should carefully review all disclosures and ensure you understand them before entering into any agreement with Debt Fix.

5. Client Obligations

By engaging with Debt Fix, you agree to: - Provide complete, accurate, and up-to-date information to enable us to assess your situation properly; - Disclose all debts, liabilities, income, and assets relevant to your financial situation; - Notify Debt Fix immediately of any changes to your financial or personal circumstances; and - Cooperate with Debt Fix and any appointed administrator, creditor, or authority as required.

Failure to provide truthful or complete information may affect your eligibility for certain solutions and may result in termination of our services.

6. No Guarantees or Warranties

Debt Fix makes no guarantee regarding the outcome of any application, negotiation, or debt solution. Debt solutions, including but not limited to Part IX Debt Agreements, informal arrangements, or refinancing, may not be suitable for all clients, and outcomes will vary depending on individual circumstances.

Debt Fix does not warrant that: - Creditors will agree to any proposed arrangement; - Interest or fees will cease to accrue; - Your credit file will not be affected; or - Any debt will be reduced, cancelled, or resolved within a specific timeframe.

7. Limitation of Liability

To the maximum extent permitted by law: - Debt Fix, its directors, employees, and agents are not liable for any loss, damage, cost, or expense (whether direct, indirect, consequential, or incidental) arising out of or in connection with your use of our services; - Debt Fix is not liable for any reliance placed on information provided that has not been independently verified or that is general in nature; - Debt Fix’s total liability to you (whether in contract, tort, or otherwise) shall not exceed the amount of fees paid by you to Debt Fix for the service in question.

Nothing in these Terms and Conditions limits any rights or remedies you may have under the Australian Consumer Law (ACL) that cannot lawfully be excluded.

8. Privacy and Confidentiality

Debt Fix collects, uses, and discloses personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy, available on our website. By engaging our services, you consent to Debt Fix collecting and sharing your information with relevant parties such as creditors, financial institutions, and regulators where necessary to perform our functions.

9. Conflicts of Interest and Commissions

Debt Fix may receive commissions or referral fees from lenders or other service providers. Any such benefits will be disclosed to you in writing prior to or at the time of engagement. Debt Fix maintains internal policies to manage conflicts of interest and ensure fair treatment of all clients.

10. Termination of Servicess

Either party may terminate services by providing written notice. If you terminate after work has commenced, you may be liable for reasonable costs incurred up to the date of termination. Debt Fix reserves the right to terminate services where: - You fail to cooperate or provide requested information; - You provide misleading or false information; or - Continuation of services would be unlawful or impractical.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.

12. Amendments

Debt Fix reserves the right to amend these Terms and Conditions at any time. Any updated version will be published on our website and will apply from the date of publication.

13. Acceptance

By engaging the services of Debt Fix Pty Ltd, you acknowledge that you have read, understood, and agree to these Terms and Conditions, including the limitations of liability and disclaimers contained herein.
